Court in Australia orders employers to compensate vaccination victims
Apr 2, 2024
In a groundbreaking ruling, the South Australian Labour Court has recognised employer liability for vaccine-related injuries when vaccination was a requirement of employment. It has ruled that the Department of Child Protection (DCP) must pay compensation and medical costs to a youth worker who developed pericarditis following a Covid booster vaccination under a workplace vaccination policy.

In a decision dated January 15, 2024, the court found that Daniel Shepherd’s employment was “a significant contributing factor” to his injury, which has left him unable to perform his duties at work ever since, Dystopian Down Under reports.
Shepherd received a Covid booster in February 2022 as a condition of his continued employment with DCP. DCP acknowledged that Shepherd’s pericarditis was caused by the booster vaccination, but denied liability for the injury, claiming that it was not due to Shepherd’s employment, but rather a lawful Public Health Order issued by the State Government (PHO). Act 2004 (EMA).
However, the court rejected DCP’s argument and ruled that Shepherd is entitled to workers’ compensation because the injury arose from both the state-mandated vaccination mandate and his employment.
“This is a good decision,” says human rights lawyer Peter Fam of Sydney law firm Maat’s Method, setting an important precedent for employers’ liability for injuries resulting from workplace vaccination requirements.
“The most important aspect of this case, in my view, is that the court found the employer liable despite an existing health order,” said Sydney lawyer Peter Fam of Maat’s Method.
Many Australian employers have sought to deflect liability for workplace injuries under the Covid vaccination requirements on the grounds that they were simply following government orders.
But under the Workers’ Compensation Act, the employer is liable if the employment is “a substantial cause of the injury,” regardless of whether other factors also contributed, Fam explains.
Although the PHO requires the employee to be vaccinated as part of their employment, “the court found that the injury they sustained as a result of the vaccination was sufficiently related to their work and employment to warrant compensation from the employer.”
Massive increase in serious side effects since the start of vaccination
Dystopian Down Under also reports on the 2021 vaccine safety report, which was finally published by the Western Australian government. As you know, an extreme pandemic policy was pursued in Australia. What happened around tennis star Novak Djokovic is remembered.
What is unique about the 2021 WA vaccine safety surveillance data is the fact that the effects of the vaccine can be easily distinguished from the effects of Covid infection. In 2021, there was almost no Covid in WA due to the extreme zero Covid policy. In contrast, almost four million doses of Covid vaccine were administered to the population in 2021.
In 2021, post-vaccination adverse events (AEFIs) were reported with the Covid vaccines at a rate of almost 24 times (per 100,000 doses) of AEFIs for all other vaccines combined. The report calls this phenomenon an "exponential increase."
The data is typical of what happened here, but in this country it is hidden.
