Higher court grants vaccine-injured plaintiff's rights, orders full re-examination of evidence

German appeals court deals crushing blow to BioNTech in serious vaccine injury case
In the latest blow to BioNTech’s stonewalling tactics, the German Oberlandesgericht Hamm has overturned a lower court ruling that had dismissed key aspects of a plaintiff’s claim for serious health damage caused by the Comirnaty mRNA COVID-19 vaccine.

The OLG Hamm is a higher regional court of appeal in North Rhine-Westphalia that hears appeals from lower district courts (Landgerichte) in civil and criminal cases.

The judgment, delivered today, April 21, 2026 (case I-26 U 57/25), completely overturns the judgment of the Landgericht Arnsberg of February 2025 (Az. I 1 O 232/23) and remands the case for proper examination of the facts of the case.

In other words, a higher German court simply sided with a vaccine injured person, overturned the lower court’s dismissal of their case, and ordered the case to be thoroughly reconsidered with real evidence instead of being quickly dismissed.

This is a significant victory for the injured plaintiffs, as it underscores that the courts must take their claims seriously and can no longer endorse BioNTech’s position without proper review.
